Leave to proceed granted on MR’s petition, stay order to remain

The Supreme Court on Friday (14) granted leave to proceed, regarding the petition filed by Mahinda Rajapaksa challenging the interim injunction issued by the Court of Appeal.

The Supreme Court bench however informed that the Interim Injunction issued by the Appeals Court on Mahinda Rajapaksa and the 48 Cabinet of Ministers from functioning will remain in place.

The consideration of the petition filed against the interim injunction order issued against the Premiership of Mahinda Rajapaksa and Ministerial portfolios of 48 other Parliamentarians concluded last evening.

The petitions were heard at Court room No. 502 of the Supreme Court.

The petitions are being heard before a trial at bar consisting Eva Wanasundera, Buwaneka Aluwihare and Vijith Malalgoda.

The petition was filed by Mahinda Rajapaksa and 48 other Parliamentarians against the interim injunction order issued by the Appeals Court suspending their posts following a petition that challenged their posts.

The petition was filed, challenging the legitimacy of Mahinda Rajapaksa and his Cabinet, following the approval of two No-Confidence Motions against the purported government in Parliament.

Earlier the Appeals Court announced that the Quo Warranto writ petition filed by 122 MPs, challenging the authority of Mahinda Rajapaksa to hold office as Prime Minister and 48 MPs to hold Ministerial portfolios will be taken up for hearing once again before Court on the 16th, 17th and 18th of January 2019.

Meanwhile the motion filed at the Supreme Court, calling for the petition to be heard before a five member bench was dismissed when the case was taken up for consideration.

Attorneys representing leader of the United National Party Ranil Wickremesinghe filed the motion .
